Obtaining Probate is the role of the Executor or Executors who are nominated in the Will. The process involves presenting the Will and Affidavits of the Executor to the court. These Affidavits set out the Assets and Liabilities of the deceased and a declaration that the will is the original. The Court will then consider the Application appropriately and Grant Probate where everything is in order. It effectively declares that the will is valid and grants Probate according to it. An Executor may call in Assets after death, but cannot distribute any Assets to beneficiaries until Probate has been granted.
