Challenging a Will

A Will is a legally binding document, but it can be challenged in certain circumstances. Those circumstances usually revolve around family members and dependents, but not all family members are eligible to contest a Will. We can assist you in establishing whether you have a claim to the Estate. If you do then it will be important to consider whether you have received something in the will or not at all. Was there any explanation in the Will why you were not provided for if it was expected. We can help you establish what the amount of your claim should be.

A claim on the estate can sometimes be settled through negotiation between the respective beneficiaries and the Executor. However, where such settlements cannot be reached then an Application would need to be lodged with the Court to contest the Will within 6 months of Probate being granted. We can assist you with negotiating a settlement and where necessary preparing and presenting your claim to Court.
